Freedom of Expression in Court
No. 34 MAY 2013
Freedom of expression is one of the fundamental pillars of a democratic regime. Without freedom of expression, apart from being diminished as people, there is no control over political power or any other power. In the United States of America, freedom of expression seems almost to have no limits, the European Convention on Human Rights gives it a primary role and the Constitution of the Portuguese Republic considers it a fundamental freedom. But in addition to the laws, it is important above all to understand how this freedom is actually experienced. Legal cases, where the limits of freedom of expression are defined, are the best raw material for understanding the scope of this freedom and these are what this work talks about.
